Revised Privacy PolicyRevised EULACurrent Privacy PolicyCurrent EULA

This End-User License Agreement ("Agreement") is between you ("you" or "End User") and Caywood Creative LLC ("Developer") and governs the AnyTour mobile application and related services (the "Licensed Application"). This Agreement is solely between you and Developer, not Apple Inc. Developer, not Apple, is responsible for the Licensed Application and its content.

By downloading, installing, accessing, or using the Licensed Application, you accept this Agreement. If you do not agree, do not use the Licensed Application.

23 sections
1 Scope of license

Developer grants you a limited, nonexclusive, nontransferable license to use the Licensed Application on Apple-branded products that you own or control, as permitted by the Usage Rules in the Apple Media Services Terms and Conditions. The Licensed Application may also be accessed by other accounts associated with the purchaser through Family Sharing or volume purchasing where Apple permits that access.

Except where applicable law prohibits the restriction, you may not reproduce, modify, translate, distribute, transfer, assign, sublicense, rent, lease, lend, reverse engineer, disassemble, decompile, attempt to derive source code from, remove proprietary notices from, or use the Licensed Application for an unlawful or unauthorized purpose.

2 Maintenance and support

Developer is solely responsible for maintenance, support, and updates for the Licensed Application. Apple has no obligation to provide maintenance or support. Contact Developer using the information in Section 7.

3 Warranty and Apple refunds

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE LICENSED APPLICATION IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT EXPRESS OR IMPLIED WARRANTIES. Developer does not warrant that the Licensed Application or AI-generated content will be uninterrupted, error-free, complete, accurate, safe, or suitable for a particular purpose.

If the Licensed Application fails to conform to an applicable warranty, you may notify Apple, and Apple may refund the purchase price of the Licensed Application. To the maximum extent permitted by law, Apple has no other warranty obligation concerning the Licensed Application. Developer is responsible for other claims, losses, liabilities, damages, costs, or expenses attributable to a failure to conform to an applicable warranty.

4 Product claims and Developer responsibility

Developer, not Apple, is responsible for addressing claims concerning the Licensed Application or your possession or use of it, including product-liability claims, claims that the Licensed Application fails to meet legal or regulatory requirements, and claims arising under consumer-protection, privacy, or similar law. Nothing in this Agreement limits liability beyond what applicable law permits.

5 Third-party intellectual-property claims

Developer, not Apple, is responsible for investigating, defending, settling, and discharging a third-party claim that the Licensed Application or your possession or use of it infringes that third party's intellectual-property rights.

6 Legal compliance

You represent that you are not located in a country subject to a United States government embargo or designated by the United States government as a terrorist-supporting country and that you are not listed on a United States government list of prohibited or restricted parties. You will comply with applicable export-control, sanctions, and other laws when using the Licensed Application.

8 Third-party services and terms

The Licensed Application uses third-party services, including:

  • Anthropic for AI narration, questions, and optional camera-image processing;
  • Cartesia for synthesized voice narration;
  • Cloudflare for secure API, database, file-delivery, and security infrastructure; and
  • Apple for App Store billing, StoreKit, Sign in with Apple, device permissions, and speech recognition.

You must comply with applicable third-party terms when using the Licensed Application. Third-party services may change, suspend, limit, or discontinue their services. See the Privacy Policy for the information sent to these providers and how it is handled.

9 Auto-renewable subscriptions

9.1 Subscription tiers and allowances

AnyTour offers bounded monthly narration allowances. Current pricing, narration-minute allowances, tour limits, and feature availability appear in the App and App Store and may change without amending this Agreement.

  • Free provides the current free monthly tour allowance and limited audio-preview behavior shown in the App.
  • Explorer provides the narration-minute allowance and features shown in the App for that tier.
  • Heritage provides the narration-minute allowance and features shown in the App for that tier, including available Heritage features.

Monthly allowances reset on the applicable schedule and do not roll over. Annual plans use the recurring monthly allowance shown in the App; annual billing does not make the entire year's allowance available at once.

9.2 Renewal and billing

Apple processes subscriptions and charges your Apple Account. A subscription renews automatically at the end of each billing period unless canceled through Apple at least 24 hours before that period ends. Manage or cancel subscriptions in your Apple Account settings.

9.3 Refunds

Apple handles subscription billing disputes and refund requests under Apple's policies. Voluntary cancellation stops future renewal but ordinarily does not create a partial-period refund. Nonwaivable consumer rights remain unaffected.

9.4 Price changes

Developer may change subscription prices. Apple will present price information and obtain any consent Apple requires. Developer will also provide the advance notice promised in the version of this Agreement then in effect and any notice required by law.

10 Consumable narration packs

10.1 Pack terms

Consumable packs are one-time, nonrenewing StoreKit purchases that grant the narration minutes shown at purchase. Minutes are reserved when a tour starts and committed when generation succeeds. Unused personal pack minutes do not expire under the current product terms. A pack is tied to the limited account created through Sign in with Apple and is not transferable.

10.2 Account and restoration

Because Apple does not restore consumables in the same manner as subscriptions, AnyTour keeps a server-side purchase and credit ledger so a verified balance can survive reinstall. Account deletion permanently removes remaining balances except for records that Developer must retain by law. Deleting the AnyTour account does not itself cancel an Apple subscription.

10.3 Pack refunds

Apple handles pack refund requests under its digital-goods policies. Minutes already committed to a successfully generated tour cannot be returned to the pack balance merely because the tour was not completed.

11 Partner Sponsored Access

11.1 How sponsored access is granted

A participating museum, travel provider, attraction, event organizer, or other organization may include an AnyTour narration benefit with a qualifying real-world service. The organization privately provides a unique claim link to an eligible recipient. The claim page identifies the participating organization, qualifying service, benefit amount, activation deadline, and benefit duration or fixed expiration before activation.

The recipient pays AnyTour nothing to claim the sponsored benefit. The participating organization compensates Developer separately under a business agreement. The claim page does not sell digital content, process payment, provide an Apple offer code, or direct the recipient to an external digital checkout.

11.2 Claim and account requirements

Sign in with Apple is required to bind a sponsored benefit to the correct limited AnyTour account. A claim link is single use. An account may hold only one active sponsored offer at a time. Sponsored access is nontransferable, has no cash value, and does not include a subscription or unrelated subscription-only benefits unless the claim page expressly says otherwise.

11.3 Duration and use

Sponsored minutes may be used only within the limits displayed in the App and claim page, including any per-tour cap. The benefit begins when the claim succeeds. It expires on the exact fixed date recorded for the claim or after the disclosed number of days, as applicable. Legacy campaigns may use a different fixed expiration disclosed by the claim page. Starting a tour reserves the selected tour's stated duration from the applicable balance; the balance is committed when generation succeeds even if the recipient listens for less time.

11.4 Ending, expiration, and forfeiture

Unused sponsored minutes are permanently forfeited when the benefit expires, is exhausted, or is voluntarily ended by the recipient after confirmation. An authorized Developer administrator may also end an individual sponsored benefit where permitted by the campaign terms, required to address misuse or error, or requested through an authorized partner process. Ending an entire campaign ordinarily prevents new claims and does not, by itself, cancel valid benefits already claimed.

Sponsored minutes are complimentary to the recipient, are not refundable or redeemable for cash, and do not convert into a personal pack, subscription allowance, or Apple credit.

11.5 Participating organization's service

The participating organization, not Developer or Apple, is responsible for its real-world service, booking, admission, ticket, transportation, lodging, event, eligibility determination, customer communications, refunds, and safety obligations. AnyTour is a separate narration service and is not a carrier, tour operator, booking agent, emergency service, or substitute for professional guidance, official instructions, site rules, or reasonable judgment.

11.6 Branding and reporting

Approved partner names, logos, and colors may appear on the claim page and in the App while sponsored access is active. Those marks belong to their respective owners and are displayed with permission. Partners receive aggregate campaign reporting and do not receive a recipient's identity, location, tour content, travel history, or AnyTour account identifier from Developer.

12 Intellectual property

The Licensed Application's code, interface, design, AnyTour marks, and Developer-provided materials belong to Developer or its licensors. Partner names, logos, colors, and other partner marks belong to their respective owners and are used under license or permission. You may not reproduce or distribute protected material except as this Agreement or applicable law permits.

AI-generated narration may contain errors and may not be unique. You may share an individual narration for personal, noncommercial purposes with attribution to AnyTour, subject to third-party rights and applicable law.

13 Feedback

If you provide suggestions, bug reports, or other feedback about AnyTour, you grant Developer a nonexclusive, worldwide, royalty-free license to use and adapt that feedback to operate and improve the Licensed Application, without an obligation to compensate or identify you.

14 Safety and disclaimer of warranties

ANYTOUR PROVIDES NARRATION FOR INFORMATION AND ENTERTAINMENT. IT IS NOT A NAVIGATION, EMERGENCY, ACCESSIBILITY, MEDICAL, LEGAL, OR PROFESSIONAL-SAFETY SERVICE. Do not rely on AnyTour to identify hazards, provide directions, interpret rules, or replace official information. AI-generated descriptions and answers may be inaccurate, incomplete, outdated, or inappropriate for the circumstances. AnyTour does not verify the real-time accessibility or physical safety of a location, private-property boundaries, or the current operating hours of a suggested location or tour stop. You remain responsible for your surroundings, conduct, route, permissions, and compliance with property rules and law.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, DEVELOPER DISCLAIMS WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, QUIET ENJOYMENT, AND NONINFRINGEMENT.

15 Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, DEVELOPER IS NOT LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES ARISING FROM THE LICENSED APPLICATION, SPONSORED ACCESS, OR A PARTICIPATING ORGANIZATION'S REAL-WORLD SERVICE. Developer's cumulative liability for claims concerning the Licensed Application will not exceed the greater of the amount you paid Developer through Apple for subscriptions and consumable packs during the twelve months before the event giving rise to the claim or USD $100. These limitations do not apply where applicable law prohibits them.

16 Arbitration and class-action waiver

Except where applicable law prohibits pre-dispute arbitration of a consumer claim, and except for a small-claims matter, a request for injunctive relief concerning intellectual-property infringement, or a dispute concerning Apple's payment processing, disputes arising from this Agreement or the Licensed Application will be resolved through binding individual arbitration administered by JAMS or AAA under applicable consumer rules. Arbitration may occur in the county where you reside or remotely. Each party bears its own legal fees, subject to applicable law and the administrator's rules.

To the extent permitted by applicable law, proceedings will occur only on an individual basis and not as a class, collective, consolidated, or representative action. If you reside in Quebec or another jurisdiction that prohibits mandatory arbitration or the waiver of class, collective, consolidated, or representative consumer proceedings, this Section does not require you to arbitrate those claims or waive those rights. You may bring such a claim in any court or consumer forum that has jurisdiction under applicable law. Mandatory consumer rights and any right that cannot legally be waived remain unaffected.

17 Changes in law and service availability

Law, AI regulation, provider availability, and technical requirements may change. Developer may modify or discontinue a feature when reasonably necessary to comply with law, protect users or the service, or respond to a material provider change. Developer will provide notice and any refund or remedy required by applicable law and the terms governing an affected Apple purchase.

Developer is not responsible for a third-party provider's unavailability or legal restriction except to the extent applicable law provides otherwise. Removing one feature does not invalidate the rest of this Agreement.

18 Termination and account deletion

You may stop using the Licensed Application at any time. If you have a limited AnyTour account, you may initiate account deletion through Settings → Account → Delete Account, as described in the Privacy Policy. Account deletion permanently removes unused pack and sponsored balances, subject to legally required retention, and does not cancel an Apple subscription.

Developer may suspend or terminate access for material violation of this Agreement, fraud, security abuse, or unlawful conduct. Developer may end an individual sponsored benefit as described in Section 11.4. Remedies, refunds, and continued access to paid balances remain subject to applicable law and Apple's policies.

19 Apple as third-party beneficiary

You and Developer acknowledge and agree that Apple and Apple's subsidiaries are third-party beneficiaries of this Agreement. Upon your acceptance of this Agreement, Apple has the right, and is deemed to have accepted the right, to enforce this Agreement against you as a third-party beneficiary.

20 Governing law and nonwaivable rights

This Agreement is governed by Florida law, without regard to conflict-of-law rules, except to the extent the law where you reside provides mandatory consumer rights or requires another governing law or forum. Nothing in this Agreement waives a right or remedy that cannot legally be waived, including applicable Canadian federal or provincial consumer rights.

21 Changes to this Agreement

Developer may update this Agreement. Developer will announce a material change through an in-app notice and/or email at least fourteen days before it takes effect for existing users, plus any longer notice required by law. Continued use after the effective date constitutes acceptance to the extent permitted by law. Nonmaterial corrections may take effect when posted.

22 Severability

If a provision is found invalid or unenforceable, it will be enforced to the maximum extent permitted or severed, and the remaining provisions will continue in effect.

23 Entire agreement

This Agreement and the Privacy Policy are the complete consumer agreement concerning the Licensed Application, except for terms Apple applies to a transaction or rights that applicable law supplies. A participating organization's separate agreement with Developer does not make the recipient a party to that business agreement or remove the recipient's independent legal rights.
